Parental Consent and Children's Privacy Notice
What a parent or guardian agrees to when booking lessons for a child under 18, what data Testlyn collects about the child, and the parent's rights and controls.
Version 1.1 · effective 17 September 2026 · code T5 · All legal documents
This notice applies when a parent or legal guardian ("you") books lessons, packages or group seats on Testlyn for a child under 18 ("your child"), or when a child under the age of digital consent uses Testlyn through a class. It adds to the Marketplace Terms for Students, the Code of Conduct and Child Safety Policy and the Privacy Policy.
1. Your consent
By ticking "I am the parent or legal guardian of this child and I agree to the Parental Consent terms" and paying, you confirm and agree that:
- you are the child's parent or legal guardian and are at least 18;
- the booking is made in your own Testlyn account and you are responsible for payments and for the child's compliance with the Code of Conduct;
- Testlyn may collect and use the child's information described in section 2 for the purposes in section 3;
- your child will take lessons following the rules in section 4.
If your child is 7 or older, you also confirm that you have explained to your child how their study information is used and that your child agrees, as the law of some countries (including Vietnam) requires the consent of both the child and the parent.
You may withdraw consent at any time (section 6).
2. Information about your child
| Information | Who gives it | Why |
|---|---|---|
| Child's first name and age range | You, when booking | So the tutor can address the child and prepare suitable lessons |
| Lesson notes you write | You | To tell the tutor the child's goals |
| Practice answers, scores, essays and speaking recordings the child submits in Teach or Learn | Your child, during study | To grade the work and show progress |
| Attendance and homework in a group course class | The tutor | To run the course |
Testlyn does not ask for the child's surname, date of birth, school, address, phone number or photo, and does not allow the child to publish a profile or post public content. Testlyn does not record lessons. Video and audio in a lesson pass through the meeting tool chosen by the tutor.
3. How we use it
Only to provide the lessons and study tools you booked, to keep the child safe, and to meet legal duties. We do not use a child's information for advertising, do not sell or share it for advertising, and do not build marketing profiles of children. Aggregated statistics that do not identify anyone may be used to improve the service.
Children's submissions may be sent to an AI grading provider to be scored. Under our agreements, providers do not use them to train their models.
4. Safety rules you agree to
- Your child takes lessons in a shared or open room, with the camera on.
- For a child under 13, you or another responsible adult are at home and reachable during every lesson.
- All communication with the tutor goes through your Testlyn account. Your child does not exchange personal contact details or social media with the tutor.
- You tell Testlyn at once if anything in a lesson worries you: [email protected], subject "Safety".
Tutors follow the child safety rules in the Code of Conduct. Tutors who teach children in the United States or Canada must hold the Kids approved badge.
5. Children under 13 (United States) and under 16 (EU, UK, Vietnam)
Testlyn does not knowingly allow a child under 13, or under 16 in the European Union, the United Kingdom or Vietnam, to open an account. Such children may use Testlyn only through your account or a class run by their teacher or school, which has obtained the consent required by law. If we learn that an account belongs to a child below these ages without that consent, we delete it.
For children under 13 in the United States, this notice is our direct notice to parents under the Children's Online Privacy Protection Act (COPPA). The operator is Testlyn LLC, 30 N Gould St Ste N, Sheridan, WY 82801, [email protected]. We collect only the information in section 2 and only as reasonably necessary for the lessons. We disclose it only to the tutor you book, to the service providers listed in the Privacy Policy who process it on our behalf, and where the law requires.
6. Your rights and controls
You can at any time, by writing to [email protected] from your account email:
- see the information we hold about your child;
- ask us to correct or delete it;
- stop further collection of your child's information and cancel future bookings, which are refunded under the Refund and Cancellation Policy;
- withdraw this consent.
We answer within 30 days, and sooner for safety matters. Deleting the child's information may mean the tutor can no longer see the child's progress.
7. How long we keep it
A child's study data is kept until you delete it or close your account, then removed within 30 days (backups within 90 days). Booking and payment records are kept for 7 years because tax law requires it; they are held under your name, not the child's.
