Tutors Marketplace Terms for Students
How booking lessons, packages and group courses with independent tutors works on Testlyn, what Testlyn does and does not do, and what you agree to when you pay.
Version 1.0 · effective 17 September 2026 · code T2 · All legal documents
These terms apply when you book or pay for a lesson, a package of hours or a seat in a group course on Testlyn Tutors. They add to the Terms of Service. The Refund and Cancellation Policy, the Code of Conduct and the Privacy Policy are part of them. If you pay in Vietnamese dong by bank transfer, the Terms for Students in Vietnam apply to that purchase instead of sections 6 and 11 of these terms.
1. Words we use
- Testlyn, we: Testlyn LLC, 30 N Gould St Ste N, Sheridan, WY 82801, USA.
- Tutor: an independent teacher who publishes a profile on Testlyn.
- Lesson: a one-to-one session of 30 minutes (trial) or 60 minutes booked with a tutor.
- Package: 5, 10, 20 or 40 hours bought in advance with one tutor.
- Group course: a fixed series of sessions a tutor runs for a small group; you buy a seat.
- You: the person who books and pays. If you book for your child, "you" is you, the parent or guardian.
2. What Testlyn is, and is not
Testlyn runs an online marketplace where students find and book independent tutors. Tutors are not our employees, agents or representatives. They decide their prices, their availability and how they teach. When you book, the agreement to provide the lesson is between you and the tutor.
Testlyn:
- shows tutor profiles and the badges we have verified (see the Verification and Badge Policy);
- takes your payment as the tutor's limited payment collection agent, which means that once you have paid Testlyn, you have paid the tutor, and the tutor may not ask you to pay again;
- holds your money under the refund rules and pays the tutor after the lesson;
- handles refunds, problems and complaints under these terms.
Testlyn is not a school and does not grant qualifications. We do not promise any exam score. Practice scores on Testlyn are estimates.
3. Who can book
You must be 18 or older and hold a Testlyn account. A student under 18 may take lessons only if a parent or legal guardian books and pays for them and agrees to the Parental Consent terms. One account is for one person; do not share it.
4. How tutors are shown
Search results are ordered by these factors, in roughly this order of weight: whether the tutor teaches the exam you filtered for; whether the tutor is based in or serves your market; rating from completed lessons; hours taught on Testlyn; how soon the tutor has open times. Tutors cannot pay for a higher position. Profiles marked as a sample or demo are not real tutors and cannot be booked for real lessons.
5. Booking
- Choose an open time on the tutor's page. Times are shown in your device's time zone.
- The time is held for 30 minutes while you pay. If payment is not completed, the time is released.
- Lessons can be booked no later than 2 hours before they start.
- You may add a note for the tutor. Do not put phone numbers, social accounts or payment details in notes.
- After payment, the lesson appears in My lessons with a link to join.
If two people try to book the same time, the first completed booking wins and the other person is told the time is no longer available.
6. Prices and payment
- Prices are set by tutors and shown before you pay, for the whole lesson, package or seat. There is no extra booking fee today; if one is introduced it will be shown separately before you pay and will not apply to purchases already made.
- Card payments are processed by Stripe in US dollars. Stripe may offer to charge in your local currency at a rate shown at checkout. Your bank may add its own foreign-transaction fee; that fee is not charged or received by Testlyn.
- We do not store your card details. Stripe's privacy policy applies to the payment data it handles.
- You receive a receipt by email from Stripe.
- Prices include any tax Testlyn is required to collect. If a tax is added in future in your country, it will be shown before you pay.
7. Trial lessons
- A trial lesson is 30 minutes, at the price the tutor sets for trials (at least 5 US dollars).
- You may take one trial with each tutor and up to three trials in any 30 days.
- A trial is a real lesson: the same cancellation and refund rules apply.
8. Taking part in a lesson
- Join on time using the link in My lessons. The tutor may use Zoom, Google Meet, Jitsi or another video tool; that tool's own terms apply to your use of it.
- If you are late, the lesson still ends at its scheduled time. If you have not joined 15 minutes after the start and have not told the tutor, the lesson may be marked as a no-show.
- If the tutor is late by more than 10 minutes, or does not appear, you may end the lesson and report it; you will be refunded in full.
- Technical problems: if the lesson cannot take place or is cut short by more than half because of the tutor's connection or equipment, you are refunded or offered a replacement lesson, as you choose. If the problem is on your side, the lesson counts as delivered.
- Testlyn does not record lessons. Neither you nor the tutor may record a lesson without the other's clear agreement, and never when the student is under 18.
9. Packages
- Packages of 5, 10, 20 or 40 hours are bought with one tutor at discounts of 0%, 5%, 10% and 15%.
- They are valid for 60, 90, 180 or 365 days from purchase. Hours not used by the expiry date lapse.
- Each 60-minute lesson you book from the package uses one hour. Trial lessons cannot be booked from a package.
- Unused hours are refundable within 14 days of purchase (see the Refund and Cancellation Policy).
- A package cannot be transferred to another person or another tutor.
10. Group courses
- A tutor sets the start date, number of sessions, schedule, minimum and maximum group size and seat price.
- Paying for a seat reserves it. The course runs only once the tutor confirms it, which the tutor can do when the minimum number of seats has been paid.
- If the course is not confirmed, or the tutor cancels it, every paid seat is refunded in full.
- You may leave and be refunded in full up to 48 hours before the first session, as long as the course has not been confirmed. After confirmation, seats are final.
- Once confirmed, you are added to the course's class on Testlyn Teach, where the sessions, homework and scores are managed.
11. Cancellations, refunds and problems
The Refund and Cancellation Policy explains every case. To report a problem with a lesson, write to [email protected] within 24 hours of its scheduled end, giving the lesson time and what happened. We may hold the tutor's payment for that lesson while we look into it, and we decide within 7 days. Our decision on a refund does not stop you from using any legal right you have.
Chargebacks. Please contact us before disputing a payment with your bank. While a chargeback is open, we may pause new bookings on your account.
12. Keep bookings and payments on Testlyn
For 12 months after your first lesson with a tutor you found on Testlyn, you agree to book and pay for lessons with that tutor only through Testlyn.
Never send money directly to a tutor or to anyone else because a message on or off Testlyn asks you to. Testlyn will never ask you to pay by bank transfer to a personal account, by gift card or by cryptocurrency. Report any such request to [email protected]. Lessons paid outside Testlyn are not covered by our refunds, protections or support.
13. Your conduct
You agree to follow the Code of Conduct. In short: be respectful, do not harass or discriminate, do not ask a tutor to take an exam or complete graded work for you, and do not share a tutor's personal details. We may cancel future bookings and close accounts that break these rules, with a refund of any lessons that we cancel.
14. Reviews
You can review a lesson once it is completed. Reviews must be honest, describe your own experience of the lesson and must not include personal information, contact details or abusive language. We remove reviews that break these rules. We do not remove a review because it is negative, and tutors cannot pay to have reviews removed. A tutor may reply once to a review.
15. What tutors see about you
When you book, the tutor sees your first name, the lesson time, your note and your progress in any class you share on Testlyn Teach. Tutors must keep this information confidential and use it only to teach you.
16. Liability
Tutors are responsible for the lessons they give. Testlyn is responsible for running the marketplace with reasonable care and skill, and for the refunds these terms promise. The limits of liability in the Terms of Service apply, and do not remove any right you have under the consumer law of your country.
17. Changes and ending
We may change these terms by publishing a new version with a new effective date. Material changes are emailed to you at least 30 days before they take effect. Changes never apply to lessons, packages or seats you already paid for. You may stop using the marketplace at any time; any refund you are owed under the Refund and Cancellation Policy remains due.
